What is a Training Contract?
All apprentices and trainees must have a formal training agreement that is binding to both the employer and the apprentice/trainee, and is signed by the employer, and the apprentice/trainee, and the parent or guardian if the apprentice/trainee is aged under 18. This document is known as a Training Contract (formerly known as an indenture) and developed with the assistance of the employer, apprentice/trainee and the RTO and submitted to the relevant state government by your chosen AAC. The selected RTO helps all participants to develop the training contract using all of the possible training options available to make sure the training satisfies the individual and organisational needs. It is possible that apprentices in the same organisation completing the same qualification will complete different training plans to suit the needs. Sometimes by using different RTO’s are able to get different training options dependant on their registration status. The training contract must be registered for any employer or employee to receive any available Government funded training, incentives and allowances. The training contract and training plan need to be completed during the probationary period of the apprenticeship or traineeship which is normally the first three (3) months of employment. It is important that the contract and plan be created as soon as possible, as DET must receive the signed training contract within one month of the end of any probationary period. Once the training contract is registered, the employer and the apprentice/trainee will receive a letter from DET and a copy of the training contract. When the training contract is signed by all respective parties the employer and the apprentice/trainee are bound by both the conditions contained in the Apprenticeship and Traineeship Act 2001 and conditions in the contract itself. It is therefore important that the training contract does not contain any false or misleading information.
